1. Definitions

• —" wavecres" / "we" / "us": The charter operation registered and operating from Koh Samui, Surat Thani, Thailand.
• —"Guest" / "you": Any individual or group booking or enquiring about a charter.
• —"Charter": A private yacht hire provided by wavecres, including the Mae Nam Coastal Cruise, Ang Thong Park Day Trip, and Samui-to-Tao Sailing Trip.
• —"Agreement": These Terms and Conditions, together with any written booking confirmation.
• —"Vessel": Any yacht operated by wavecres for charter purposes.

2. Acceptance of Terms

By submitting a booking enquiry, confirming a charter booking, or boarding a wavecres vessel, you confirm that you have read and agree to these Terms. Guests must be at least 18 years of age to enter into a booking agreement. Minors may participate in charters when accompanied by a responsible adult who has agreed to these Terms on their behalf.

3. Service Description

wavecres offers private yacht charters departing from Mae Nam pier, Koh Samui. Current charter options include: the Mae Nam Coastal Cruise (half-day), the Ang Thong Park Day Trip (full day), and the Samui-to-Tao Sailing Trip (multi-day). All departures are weather-dependent. Services are available to guests of all nationalities.

4. Booking and Payment

Bookings are confirmed upon receipt of a deposit as specified in your charter quote. The remaining balance is due no later than 48 hours before the departure date unless otherwise agreed in writing. Prices are quoted in Thai Baht (฿). We accept bank transfer and major credit cards. Quoted prices are all-inclusive as described for each charter; no additional surcharges will be applied after confirmation.

5. Weather and Rescheduling

All charters are weather-dependent. If conditions on the day of departure are assessed by the captain as unsafe for the planned route, wavecres will notify guests at the earliest opportunity and arrange a rescheduled date at no additional charge. The decision to proceed or reschedule rests with the captain and is final. No refund is available for weather-related rescheduling; rescheduling to a mutually agreed date is the standard remedy.

6. Cancellation Policy

• —Cancellation more than 7 days before departure: full deposit refund.
• —Cancellation 3–7 days before departure: 50% of deposit refunded.
• —Cancellation less than 3 days before departure: deposit is non-refundable.
• —No-show on departure day: full charter fee is non-refundable.

All cancellations must be made in writing by email to info@{{DOMAIN_NAME}}.

7. Guest Responsibilities

Guests are expected to:

• —Arrive at Mae Nam pier at the agreed departure time
• —Follow safety instructions from the captain and crew at all times
• —Treat the vessel and crew with respect
• —Disclose any medical conditions relevant to participation in maritime activities
• —Not bring or consume illegal substances onboard
• —Comply with Department of National Parks rules in Ang Thong and other protected areas

8. Intellectual Property

All content on the wavecres website — including text, images, and design elements — is the property of wavecres unless otherwise indicated. You may not reproduce, distribute, or use any content for commercial purposes without our written permission.

9. Disclaimers

Maritime activities involve inherent risks, including but not limited to sea conditions, weather, and physical exertion. wavecres takes reasonable precautions to ensure guest safety, but cannot eliminate all risk associated with sailing and water activities. Services are provided as described, but itineraries may be modified by the captain based on conditions. We do not make representations about specific outcomes from any charter.

10. Limitation of Liability

To the extent permitted by Thai law, wavecres's liability for any claim arising from a charter is limited to the price paid for that specific charter. We are not liable for indirect, consequential, or incidental damages. Nothing in these Terms limits liability for death or personal injury caused by our negligence.

11. Indemnification

You agree to indemnify wavecres against claims, losses, or expenses arising from your breach of these Terms, your conduct onboard, or any harm caused to third parties or to the vessel through your actions.

12. Termination

We reserve the right to refuse or terminate a charter if a guest's conduct poses a safety risk or is disruptive to the crew or other passengers. In such cases, the guest may be returned to Mae Nam pier and no refund will be provided. Either party may terminate a booking agreement in accordance with the Cancellation Policy above.

13. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes arising from a charter or from these Terms shall first be addressed through direct communication between the parties. If a resolution cannot be reached, disputes may be referred to the courts of Surat Thani Province, Thailand. We encourage guests to raise any concerns with us directly at the earliest opportunity.

14. General Provisions

These Terms constitute the entire agreement between you and wavecres relating to charter bookings. If any provision is found unenforceable, the remaining provisions continue in full effect. Failure to enforce any right under these Terms does not constitute a waiver of that right.

15. Changes to These Terms

We may update these Terms from time to time. Changes take effect from the date shown at the top of this page. Bookings confirmed before a change remain subject to the Terms in place at the time of booking.
