1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you ("Guest" or "you") and waveolas ("we," "us," or "our") regarding your use of our coastal property rental services in Thailand. By accessing our website, making property inquiries, or booking accommodations, you acknowledge that you have read, understood, and agree to be bound by these terms.

If you do not agree with any part of these terms, you must not use our services or make property reservations. These terms apply to all users of our services including website visitors, property inquirers, and confirmed guests.

2. Definitions

"Service" refers to coastal property rental management and accommodation services provided by waveolas including property listings, booking coordination, guest support, and property access facilitation.

"Property" refers to any beachfront access property, ocean view villa, or coastal estate compound listed through our service and available for short-term rental accommodation.

"Booking" refers to confirmed reservation of a Property for specified dates following acceptance of booking request and receipt of required deposit payment.

"Agreement" refers to these Terms and Conditions together with any specific booking confirmation, property rules, and supplementary terms provided during reservation process.

3. Eligibility and Account Requirements

You must be at least 18 years of age to make property bookings or enter into agreements with waveolas. By making a reservation, you represent and warrant that you have the legal capacity to enter into binding contracts under applicable law.

You are responsible for maintaining accurate contact information including email address and phone number for booking communications. Failure to maintain current contact information may result in missed important booking updates or property access instructions.

You agree to provide truthful and complete information during booking process including accurate guest count, intended property use, and special requirements. Providing false information may result in booking cancellation without refund.

4. Booking Process and Confirmation

Property bookings follow this process:

Inquiry Submission: You submit booking inquiry specifying desired dates, guest count, and property preferences through our website or direct contact.

Availability Confirmation: We confirm property availability for requested dates and provide detailed property information, pricing breakdown, and booking terms.

Deposit Payment: Booking becomes confirmed upon receipt of required deposit payment, typically 30% of total booking value. Payment must be received within 48 hours of availability confirmation to hold reservation.

Booking Confirmation: We send written confirmation including property details, check-in instructions, payment schedule, and cancellation terms via email.

Reservations are not considered confirmed until deposit payment is received and written confirmation is provided. Property availability is not guaranteed until confirmation is issued.

5. Pricing and Payment Terms

All prices are quoted in Thai Baht (฿) unless otherwise specified. Pricing includes property rental for specified period and listed amenities. Additional services such as airport transfers, catering, or activity bookings are priced separately when requested.

Payment schedule follows this structure: 30% deposit due upon booking confirmation, remaining 70% balance due 30 days before check-in date. For bookings made within 30 days of arrival, full payment is required at time of booking.

We accept payment via bank transfer, credit card, or other methods specified during booking process. Credit card payments may incur processing fees of 3% which will be clearly disclosed before payment.

Security deposits may be required for certain properties, typically 20-30% of booking value. Security deposits are refundable within 14 days of checkout subject to property inspection confirming no damage or policy violations.

6. Cancellation and Refund Policy

Cancellation terms vary based on timing of cancellation notice:

More than 60 days before arrival: 80% refund of total booking value. Deposit and payment processing fees are non-refundable.

30-59 days before arrival: 50% refund of total booking value. Deposit forfeited, partial refund of balance payment.

Less than 30 days before arrival: No refund. Full booking value is forfeited regardless of cancellation reason.

Cancellations must be submitted in writing via email to [email protected]. Cancellation date is determined by date we receive written notice, not date of departure.

We strongly recommend purchasing travel insurance to protect against unforeseen circumstances requiring cancellation. We are not responsible for costs incurred due to cancellations regardless of reason including medical emergencies, travel restrictions, or weather events.

7. Check-In and Check-Out Procedures

Standard check-in time is 3:00 PM on arrival date. Standard check-out time is 11:00 AM on departure date. Early check-in or late check-out may be available upon request subject to property availability and may incur additional charges.

You will receive detailed check-in instructions via email 48 hours before arrival including property address, access codes or key collection procedures, and emergency contact information.

You must complete check-in procedures including property orientation and condition documentation. Failure to report pre-existing property damage or issues within 24 hours of check-in may result in charges for these items.

At check-out, you must leave property in reasonable condition including removal of personal belongings, proper disposal of garbage, and return of any provided equipment to designated storage areas.

8. Guest Responsibilities and Conduct

During your stay, you agree to:

Comply with maximum occupancy limits specified in booking confirmation. Exceeding guest capacity without prior approval may result in immediate booking termination without refund.

Maintain reasonable noise levels and respect neighboring properties, particularly during evening hours between 10:00 PM and 8:00 AM.

Use property and amenities in reasonable manner consistent with normal residential use. Properties are intended for vacation accommodation, not commercial activities or events.

Follow property-specific rules provided during check-in including beach access procedures, equipment usage guidelines, and facility maintenance requirements.

Supervise minor children at all times, particularly around beach areas and water facilities. We are not responsible for child safety or supervision during your stay.

Prohibited activities include smoking in non-designated areas, hosting unauthorized events or parties, illegal activities, and violation of local regulations or Thai law.

9. Property Damage and Liability

You are responsible for any damage to property, furnishings, or equipment caused by you or your guests during the stay period. This includes damage from negligence, intentional acts, or failure to follow property usage guidelines.

We will assess damage costs based on repair or replacement value using local market rates. Damage charges will be deducted from security deposit. If damage exceeds security deposit, you agree to pay additional charges within 14 days of invoice.

You must report any property damage, equipment malfunction, or maintenance issues immediately to enable prompt resolution. Delayed reporting may limit our ability to address issues during your stay.

We maintain liability insurance for property damage. However, guests are responsible for their personal belongings and should maintain appropriate travel insurance covering personal property, liability, and medical expenses.

10. Service Limitations and Disclaimers

Properties and services are provided "as is" without warranties or guarantees beyond those explicitly stated in booking confirmations. We make reasonable efforts to ensure property descriptions, photos, and amenity listings are accurate but cannot guarantee perfect accuracy.

We are not responsible for: temporary utility disruptions including water, electricity, or internet services; weather conditions affecting beach access or outdoor activities; wildlife or natural phenomena common to coastal environments; or changes to surrounding area conditions beyond our control.

Beach and ocean access carry inherent risks including tidal changes, marine life, and water conditions. Guests use beach facilities and engage in water activities at their own risk. We provide safety orientation but cannot guarantee ocean conditions or prevent all potential hazards.

Property amenities including appliances, equipment, and facilities are subject to normal wear and occasional malfunction. We will address maintenance issues promptly when reported but cannot guarantee immediate resolution of all problems.

11. Limitation of Liability

Our total liability for any claims arising from your booking or stay shall not exceed the total amount paid for your reservation. This limitation applies regardless of the legal theory of liability including contract, negligence, or other claims.

We are not liable for indirect, consequential, incidental, or punitive damages including lost profits, travel expenses, alternative accommodation costs, or other losses beyond direct property rental value.

We are not liable for personal injury, illness, death, or property loss occurring during your stay except where caused by our gross negligence or intentional misconduct as determined under Thai law.

Some jurisdictions do not allow limitation of liability for certain types of damages. In such cases, our liability is limited to the maximum extent permitted by applicable law.

12. Intellectual Property

All website content including property descriptions, photographs, logos, graphics, and text are owned by waveolas or licensed from property owners. You may not reproduce, distribute, modify, or create derivative works from this content without written permission.

You may view and print website content for personal booking purposes only. Commercial use of content, systematic downloading, or republication of property listings is prohibited.

13. Privacy and Data Protection

Collection, use, and protection of your personal information is governed by our Privacy Policy available at Privacy Policy. By using our services, you consent to data practices described in the Privacy Policy.

14. Modification of Services and Terms

We reserve the right to modify these Terms and Conditions at any time. Material changes will be communicated via email to guests with active bookings. Continued use of services after changes constitutes acceptance of modified terms.

Changes to terms do not affect bookings confirmed before the change unless modifications are required by law or necessary for safety reasons.

15. Termination Rights

We reserve the right to terminate your booking and refuse service for violation of these terms, providing false information, engaging in illegal activities, damaging property, disturbing other guests or neighbors, or behavior that threatens safety or well-being of others.

Termination for policy violations results in forfeiture of all payments with no refund. You must vacate the property immediately upon notice of termination. Failure to vacate may result in legal action and additional charges.

16. Dispute Resolution

If disputes arise regarding booking, services, or these terms, you agree to first attempt resolution through good faith negotiation by contacting us at [email protected].

If informal resolution is unsuccessful within 30 days, disputes shall be resolved through binding arbitration in Bangkok, Thailand under Thai Arbitration Act B.E. 2545 (2002). Arbitration shall be conducted in English by a single arbitrator agreed upon by both parties.

You waive the right to participate in class action lawsuits or class-wide arbitration against waveolas. All disputes must be brought individually.

17. Force Majeure

We are not liable for failure to perform obligations due to circumstances beyond our reasonable control including natural disasters, government restrictions, public health emergencies, war, terrorism, severe weather, or utility failures.

In force majeure situations, we will make reasonable efforts to provide alternative accommodations or reschedule bookings. However, we are not obligated to provide refunds for cancellations caused by force majeure events.

18. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Thailand without regard to conflict of law provisions. Any legal action or proceeding related to these terms shall be brought exclusively in courts located in Bangkok, Thailand.

You consent to personal jurisdiction of Thai courts and waive any objection to venue in Bangkok courts for disputes arising from these terms or your use of our services.

19. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid under applicable law, such provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary. All remaining provisions shall continue in full force and effect.
